Contest Terms
How to Enter
No purchase necessary. Entry is open to front line sales travel agents based in four separate regions; Canada, United States, United Kingdom and Australia/ New Zealand. Entry is based on completion of TRACKS agent training and evidence of one new booking made between 00:01 February 10, 2020 and 23:59 March 27, 2020 UTC for guest travel onboard the Rocky Mountaineer in the 2020 travel season. Agent must have completed TRACKS agent training at the time of booking for a valid entry. Each Agent is eligible for a maximum of one entry. Rocky Mountaineer may disqualify any entrant that does not comply with these terms.
The Prize
One prize will be awarded for entrants based in each of the contest regions, being Canada, United States, United Kingdom and Australia/ New Zealand for a total of four prizes.
For two adults, travelling together and shared accommodation, a two-day, all daylight rail journey on the First Passage to the West route travelling eastbound or westbound onboard Rocky Mountaineer in GoldLeaf Service. One-night hotel accommodation in each of Vancouver, Kamloops and Banff is included (three nights total). The prize has an approximate value of CAD$7,500.00. The prize must be taken during the 2020 Rocky Mountaineer travel season which operates from April 13 to October 11, 2020. Refer to www.rockymountaineer.com for rail service departure dates. Prize reservations are based upon availability of space for the period requested. Blackout dates apply. The prize has no cash value, is non-transferable and cannot be substituted or redeemed for cash. Any items of a personal nature, spending money, air or ground transportation, upgrades, additional accommodation, transfers, additional expenses, tour add-ons, return transportation, travel visas, insurance or gratuities are the responsibility of the individual traveler(s) and are not included in the prize. Rocky Mountaineer may substitute the Prize for a different prize of equal or greater value.
Contest Winner
Contest winner will be selected from all eligible entries received in each contest region, by means of a computer-generated random draw. Draw will take place on March 30, 2020. Selected entrant from each region will be notified by email by no later than 11:59pm PST on March 31, 2020. The selected entrant will have 48 hours to claim their prize following receipt of the email notification by contacting Rocky Mountaineer and answering a skill-testing question. If the selected entrant fails to claim their prize in accordance with these terms, or is unable to claim the prize as provided, a second entrant will be selected from the remaining eligible entries in that contest region in accordance with the above procedure until the prize is claimed in accordance with these terms. The selected entrant who claims the prize in accordance with these terms will be deemed to be the winner of the contest. Odds of winning depend on number of eligible entries received in each contest region.
General Terms
By entering the contest and accepting the Prize, the winner agrees to the publication, reproduction and/or other use by Rocky Mountaineer of his/her name, address, voice, statements about the Sweepstakes and/or photograph or other likeness without further notice or compensation in any manner whatsoever, including, without limitation, print, broadcast or the Internet.
Rocky Mountaineer, including its directors, officers, partners, dealers, employees, affiliates, associates and their respective agents, representatives successors and assigns are not responsible for any direct or indirect liability regarding the contest or the prize, including without limitation any entry, prize winning notification or claim for any prize that is lost, misdirected or that arrives late, as the case may be, whether or not due to the fault of Rocky Mountaineer or of any other person or thing.
Rocky Mountaineer may amend these terms from time to time without notice to the extent permitted by applicable law. Rocky Mountaineer may cancel, suspend or conclude the contest prior to the expiration of the contest period if a virus, non-human intervention, or fraud is detected or suspected that in the opinion of Rocky Mountaineer affects the contest in any way. In this event Rocky Mountaineer will select a winner in accordance with the above terms from among all eligible entries received prior to such event occurring.
These terms are governed and construed in accordance with the laws of the Province of British Columbia and the laws of Canada applicable therein. The parties irrevocably submit to the exclusive jurisdiction of the Courts of the Province of British Columbia in relation to any legal action or proceedings arising out of or in connection with these terms.
